Terms of sale
These Terms of Sale apply to all purchases of goods and services from Clearly Hearing Ltd. By placing an order online, by phone, or in person, you agree to these terms. These terms do not affect your statutory rights as a consumer.
1. Who we are
Clearly Hearing Ltd is a company registered in England and Wales, providing specialist audiology and hearing care services including hearing aid fittings, ear wax removal, auditory processing disorder assessment, tinnitus support, and hearing protection.

In these terms, “we”, “us” and “our” refer to Clearly Hearing Ltd, and “you” or “your” refer to the customer or patient.
2. Customer eligibility and responsibilities
By purchasing from Clearly Hearing Ltd, you confirm that:
- You are aged 18 or over.
- You have had a hearing assessment performed by one of our audiologists, or another HCPC-registered audiologist, within the last 6 months — including case history, otoscopy and audiometry.
- You can provide a copy of your hearing test results and complete a medical questionnaire before any hearing aid purchase.
- You understand that hearing aids will be programmed to your individual hearing thresholds, and that Clearly Hearing Ltd is not liable for issues arising from inaccurate or incomplete audiograms.
- You agree that some aftercare services may be delivered online or by remote connection.
- You are purchasing devices for personal use only and not for resale, research or competitive purposes.
3. Orders and acceptance
- Orders may be placed through our clinics, by phone, email or online.
- Submission of an order represents an offer to purchase. We will confirm acceptance once payment has been processed and eligibility verified.
- Placing an order signifies agreement to our Privacy Policy, Returns and Refund Policy, and Warranty and Aftercare Policy.
- We reserve the right to decline or cancel any order where clinical suitability, documentation or payment cannot be confirmed.
4. Prices and payment
- All prices are in pounds sterling (£) and include VAT where applicable.
- We take reasonable care to ensure accuracy of pricing but reserve the right to correct errors before accepting an order.
- Payment must be received in full before goods or services are supplied, unless otherwise agreed in writing (for example, insurance authorisation or a payment plan).
- We may offer interest-free or low-interest payment plans, subject to approval.

Hearing aids and custom products (such as ear moulds and custom earplugs) are bespoke medical devices and may not be eligible for full refunds unless found faulty or unfit for purpose.
You have the right to cancel standard service purchases within 14 days of payment (before service delivery), in accordance with the Consumer Contracts Regulations 2013.
6. Limitation of supply
We make every effort to fulfil all orders but cannot guarantee product availability. If a product is unavailable, we will notify you promptly and offer a suitable alternative or a full refund.
7. Warranty and aftercare
Please see our Warranty and Aftercare Policy for full details. Manufacturer warranties typically range between 2 and 5 years depending on the brand. Warranty does not cover damage caused by misuse, neglect, exposure to moisture or unauthorised repairs.
8. Warranty limitations
The manufacturer’s warranty will not cover:
- Damage from accidental drops, water exposure or physical impact.
- Modifications or repairs carried out by unauthorised providers.
- Cosmetic damage, loss or theft.
Unauthorised servicing will void your warranty.
9. Limitation of liability
Clearly Hearing Ltd shall not be held liable for:
- Normal wear and tear or user-caused damage.
- Minor deviations between advertised and supplied goods.
- Delays in delivery due to factors beyond our control.
- Discomfort arising from failure to follow audiological guidance.
Our total liability shall not exceed the amount paid for the product or service in question. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
10. Governing law
These Terms of Sale are governed by the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
By purchasing from Clearly Hearing Ltd, you agree to these Terms of Sale, which ensure transparent pricing, safe clinical care, and fair protection for both patient and provider.
